Please read these Terms & Conditions ("Terms") carefully before placing an order or making a purchase with Harlem Gourmet Grocery & Deli ("we," "us," or "our"). By engaging with our services, you agree to be bound by these Terms.
Operation: Harlem Gourmet Grocery & Deli operates as a retail grocery store and deli offering prepared foods, sandwiches, groceries, and catering services (as available) at 1979 Adam Clayton Powell Jr Blvd, New York, NY 10026.
Hours: We are generally open 24 hours a day, 7 days a week, but reserve the right to modify operating hours due to unforeseen circumstances, holidays, or emergencies without prior notice.
Pricing: All prices are subject to change without notice. Prices listed on menus, boards, or online platforms are correct at the time of publication but may be updated. The price charged will be the prevailing price at the time of order placement.
Payment: We accept cash and major credit/debit cards via our secured Point-of-Sale (POS) system. We do not store customer payment details.
Sales Tax: Applicable local and state sales tax will be added to the price of all taxable items as required by law.
Availability: All products, including menu items and grocery goods, are subject to availability. We reserve the right to substitute ingredients or items of equal or greater value if a specific item is out of stock.
Order Confirmation: It is the customer's responsibility to review and confirm the accuracy of their order before finalizing payment (in-person) or hanging up (phone order).
Corrections: If you receive an order that is incorrect, please notify us immediately by phone so we can attempt to correct the issue or offer a suitable remedy.
Prepared Foods: Due to the perishable nature of prepared foods (sandwiches, salads, hot entrees), we do not offer refunds or exchanges unless the item is demonstrably incorrect or defective at the time of pickup or delivery.
Grocery/Packaged Goods: Unopened, non-perishable grocery items may be returned within 48 hours of purchase with a valid receipt for store credit or exchange.
Requesting a Refund: All refund or exchange requests must be made by contacting the deli by phone or in person within a reasonable time of purchase, accompanied by proof of purchase. Refunds are issued at the sole discretion of the management.
Third-Party Platforms: For delivery orders, we utilize various third-party delivery platforms (e.g., DoorDash, UberEats, etc.).
Delivery Terms: The delivery fee, estimated time, and specific delivery policies (including liability for late or damaged orders during transit) are governed by the terms and conditions of the respective third-party platform. We are responsible for preparing the order correctly; the delivery platform is responsible for the transport.
Service Area: Delivery is subject to the service area defined by the third-party platforms.
All content, logos (including the Harlem Gourmet Grocery & Deli logo), and unique menu names developed by us are the property of Harlem Gourmet Grocery & Deli and are protected by applicable intellectual property laws. You may not use, copy, or distribute any material without our express written permission.
Harlem Gourmet Grocery & Deli is not responsible for any issues arising from the consumption of food after it has been picked up or delivered, especially if the food has not been consumed promptly or stored properly. We are not liable for any injuries or damages resulting from the use of third-party delivery services.
We reserve the right to modify or replace these Terms at any time. The "Last Updated" date at the top of this page will indicate when the most recent changes took effect. Continued use of our Service after any modification constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
